  1. The Document (hereinafter – the Policy) is designed to inform the natural persons specified in the Policy about the activities performed on their personal data by SIA “Atlas Aerospace”, registration number: 40103911104, registered office: 19A Ulbrokas Street, Riga, LV-1021, Latvia (hereinafter – Atlas Aerospace).
  2. Atlas Aerospace specializes in the production of professional unmanned aerial vehicles.

    • The policy governs the processing of personal data relating to individuals, which applies to all Atlas Aerospace:
      • existing customers who are natural persons and who use the Atlas Aerospace Services;
      • potential customers who are natural persons who have no relationship with Atlas Aerospace and who are interested in the Atlas Aerospace Services;
      • former customers, including those who have defaulted or who have agreed to receive commercial communications after termination of the agreement;
      • customer representatives, including contacts and legal representatives;
      • information system, website users;
      • natural persons engaged in marketing activities.
    • The Policy provides information on how Atlas Aerospace handles personal data in connection with the Services offered by Atlas Aerospace through its internal resources, including information systems, social networks and websites:

  • In order to inform of the processing of personal data, Atlas Aerospace provides the following information in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) 2016/679 (April 27, 2016) on the protection of natural persons with regard to the processing of personal data (hereinafter the Regulation).   1. Personal Data and Purposes of Personal Data Processing
    • Personal data is any information relating to an identified or identifiable natural person (data subject).
    • Atlas Aerospace processes personal data:
      • for Atlas Aerospace Services:
        • for the conclusion and implementation of contracts and the provision of Services;
        • for settlements and payments;
        • for financial accounting.
      • to improve Atlas Aerospace Services and for business planning purposes:
        • for customer consultation;
        • to inform customers and keep them up to date with Atlas Aerospace news.
        • for statistics and business analysis (including business planning);
        • for record keeping and bookkeeping, including archiving information.
      • for security and rights protection purposes:
        • for prevention and investigation of personal data processing breaches;
        • for safety in the premises of Atlas Aerospace;
        • to provide information to public authorities and other persons.
      • To comply with regulatory enactments or to enforce Atlas Aerospace rights in accordance with regulatory enactments:

  1. Legal Grounds for Personal Data Processing
    • Atlas Aerospace processes the Personal Data in the following cases:
      • there is or will be a contract between you and Atlas Aerospace. In this case, Atlas Aerospace processes the Personal Data for the purpose of performing the contract or taking action upon request prior to the conclusion of the contract.
      • processing of personal data is necessary for compliance with legal obligations regarding Atlas Aerospace as required by law. Atlas Aerospace is obliged to provide information to public authorities, to comply with accounting records management obligations and to archive documents.
      • processing of personal data is necessary for the legitimate (legal) interests of Atlas Aerospace or a third party;
        • legitimate interest is a right the exercise of which is permitted by law, including in the context of a contract entered into with and between Atlas Aerospace. Atlas Aerospace has the following legitimate interests:
          • to ensure the development of its commercial activities;
          • to create and develop Services and ensure the improvement thereof;
          • to ensure a positive relationship with the Customers;
          • to prevent potential financial and organizational risks;
          • to eliminate legal risks (for example, in the event of a potential dispute, to keep Personal Data for a limited period of time to resolve the dispute);
          • to prevent security risks;
          • to enforce contractual obligations and to ensure proper performance of contracts;
          • to protect its financial interests;
          • to retain and attract Customers;
          • to maintain, develop and implement improvements to the websites and ensure their use by Customers;
          • to maintain, develop and implement social network profiles, and ensure that they are used by Customers;
          • to carry out marketing activities, including promoting and distributing the Services;
          • to protect its rights through the services of authorized and competent authorities.
  1. Recipient and Sources of Personal Data
    • Atlas Aerospace may transfer Personal Data to the following recipients:
      • Atlas Aerospace employees and authorized persons who process the Personal Data specified in this Policy on behalf of Atlas Aerospace, within the scope of their responsibilities and duties.
      • to parties involved in the provision of Atlas Aerospace Services and business development:
        • to information system consultants and their service providers;
        • to mail and delivery service providers;
        • to banks and other settlement and financial services providers as well as providers of information exchange between Atlas Aerospace and financial services providers;
        • to public information service providers (such as the media);
        • to insurance providers;
        • to legal service providers;
        • to debt collection service providers and credit information bureaus;
        • to security and safety service providers.
      • to the authorized persons with whom Atlas Aerospace communicates for the provision of the Services or for the protection of its interests, and for other purposes stated in this Policy;
      • to the law enforcement agencies, other government agencies, and public persons, and similar persons, if deemed necessary or required under applicable law (e.g., Law Enforcement, State Revenue Service, Notaries Public).
    • In addition, Atlas Aerospace may receive personal data from third parties such as:

  1. Personal Data Processing Time Limit
    • Personal data shall be processed to the extent reasonably required by the particular purpose of the data processing, subject to applicable laws and regulations.
    • Atlas Aerospace stores Personal Data:
      • as long as required or permitted by regulatory enactments;
      • as long as the contract is in force (if this Personal Data relates to this particular contract only)
      • to the extent necessary to achieve the purposes for which the Personal Data are processed, as set out in Clause 4 and sub-clauses of Clause 4 of the Policy.
  1. Transfer of Personal Data Outside the European Union
    • Where Atlas Aerospace transfers Personal Data outside the European Union, all necessary safeguards in accordance with the Regulation shall be respected.
  1. Rights of the Data Subject (You) in the Processing of Personal Data
    • Rights of the data subject with respect to the Personal Data referred to in this Policy:
      • Access rights:
        • obtain approval from Atlas Aerospace as to whether or not Personal Data is being processed with respect to the Data Subject,
        • if Atlas Aerospace processes your Personal Data, you have the right to access the relevant Personal Data and receive information on the purposes of the processing, Personal Data categories, recipient categories, Personal Data retention period, your data protection rights, source of Personal Data and automated decision making (if any). This information may be familiarized with in this Policy.
        • Additional information regarding your Personal Data may be obtained from the Atlas Aerospace contact information specified in Clause 3 and sub-clauses of the Policy!
        • Where applications are submitted electronically, Atlas Aerospace shall provide the information in electronic form.
      • Rights of Rectification
        • You have the right to request Atlas Aerospace to correct inaccurate Personal Data.
      • Right of Deletion
        • You have the right to request Atlas Aerospace to delete your Personal Data if:
        • You have withdrawn your consent to the processing of Personal Data, given that the withdrawal of consent does not affect the processing carried out during the term of your consent;
        • Personal data are no longer needed for the purposes for which they were processed under the terms of Clause 4 and sub-clauses of the Policy;
        • Personal data is processed illegally;
        • Personal data must be deleted in accordance with regulatory requirements.
        • The right of deletion does not apply where, under the law, Atlas Aerospace is required to process Personal Data, or processing is necessary for archiving, public interest or statistical purposes, or for the purpose of instituting, enforcing or defending a legitimate claim.
      • Right to Restrict the Processing of Personal Data
        • You have the right to request that Atlas Aerospace restrict the processing of Personal Data if:
          • You contest the accuracy of the Personal Data or the lawfulness of the processing (the restriction will be in force while the appeal process is in progress);
          • Processing of Personal Data is illegal, but you object to the deletion of Personal Data;
          • Atlas Aerospace Personal data is no longer needed, but you need it to raise, enforce, or defend within legal claims.
        • Right to Object Against Processing
          • You have the right at any time to object to the processing of your Personal Data based on the legitimate interests and consent of Clause 5 and sub-clauses. Atlas Aerospace has the right to continue to process Your Personal Data, regardless of any objections we receive, provided that Atlas Aerospace invokes compelling legitimate reasons for processing that outweigh your interests, rights and freedoms, or to raise, enforce, or defend within lawful claims
        • Right to Withdraw Consent
          • You have the right to withdraw your consent to the processing of Personal Data in cases where consent to the processing of Personal Data is the basis.
          • You may use the contact information for Atlas Aerospace listed in Clause 3 and sub-clauses of the Policy to withdraw your consent.
          • If you withdraw your consent, Atlas Aerospace has the right to restrict the provision of services, subject to the availability of relevant Personal Data.
          • The withdrawal of consent shall not affect the processing carried out during the period of validity of the consent given.
        • Right to Portability.
          • You have the right to receive your Personal Data provided by you to Atlas Aerospace, in a structured, widely used and machine-readable format and to request such data to be transmitted to another controller (service provider) if such Personal Data is processed on a contractual or consent basis.
        • Right to Submit a Complaint
          • You have the right to complain to Atlas Aerospace, as well as to the Latvian supervisory authority, the Data State Inspectorate, if you believe that your Personal Data Protection Rights have been violated. If you wish to make a complaint to the State Data Inspectorate, please contact Atlas Aerospace before contacting the Inspectorate. Atlas Aerospace takes care of the protection of your Personal Data and will provide you with the support you need.
          • Except as otherwise provided in this section, you may use the Atlas Aerospace contact information specified in Clause 3 and sub-clauses of the Policy to exercise the above rights.
